Club Card Membership Agreement

CLUB CARD GENERAL RULES AND CONDITIONS

Club Card Program, is the world of digital solutions and personalized advantages which is offered to our valued guests by Ak-Günler İşletmeleri Şti Ltd (hereinafter referred to as “AKGÜNLER”) who is the operator and owner of all rights thereof and which is the address of fast, comfortable and safe travel. Club Card offers the opportunity to collect Akgünler Ticket Points during your AKGÜNLER (Ferry and Sea Bus) sea travels. AKGÜNLER reserves the right to include brands that have agreements with Club Card and to ensure that Akgünler Ticket Points are earned and spent through them. AKGÜNLER has the authority to regulate the Club Card General Rules and Conditions and reserves the right to change these rules and conditions without any notice and responsibility. Club Card or Club Card Program will be referred to as ‘SeaMile by Akgünler’ in future publications and/or advertisements of AKGÜNLER.

• 1. Membership
  • 1.1. Conditions to become member:

    For individual membership applications, the person must be over 18 years of age and present an ID Card.

  • 1.2. Membership channels are;

    www.akgunlerdenizcilik.com, www.akgunlerbilet.com, All Akgünler Denizcilik Port Offices, Akgünler Denizcilik Call Center (0392 444 43 64)

    • 1.2.1. Individual Memberships:

      A real person who want to become a Club Card member, can apply for pre-membership through www.akgunlerdenizcilik.com>, www.akgunlerbilet.com, All Akgünler Denizcilik Port Offices or Akgünler Denizcilik Call Center (0392 444 43 64). Member candidates who complete the mandatory information for membership in the application form, approve the Club Card General Rules and Conditions sent to their mobile phones as a personalized SMS and then become active members after being checked and confirmed by Akgünler Denizcilik system administrators. By filling out the application form, it will be assumed that the Club Card General Rules and Conditions have been read, understood and accepted by the applicant, without requiring the applicant's wet signature.

    • 1.3. Termination of membership:

      Club Card members may terminate their membership at any time and without any notice period, by giving a written notice to [email protected]

    • 1.4. Validity of Club Card registrations:

      Subject to these General Terms and Conditions, only AKGÜNLER is the sole authority regarding the management of Club Card accounts, calculation of Akgünler Ticket Points, loading into the account and usage thereof.

• 2. Akgünler Ticket Points
  • 2.1. Calculation unit:

    Akgünler Ticket Points are the reward Ticket Points earned by Club Card members from AKGÜNLER (Ferry and Sea Bus) sea travels. Akgünler Ticket Points are processed into the account as “blocked” immediately after the ticket purchase and can be used as “active” within minimum 24 hours after the journey.

  • 2.2. Akgünler Ticket Points Account :

    Each member has a Club Card member account where the earned Akgünler Ticket Points are recorded. Akgünler Ticket Points and Club Card accounts are not transferable and cannot be combined with Akgünler Ticket Points of an other Club Card member. Akgünler Ticket Points are spent as specified within the Club Card, cannot be converted to cash and no cash equivalent is given in return. In the event of cancellation of Club Card membership, Akgünler Ticket Points accumulated in the accounts cannot be returned and cannot be converted to cash. AKGÜNLER reserves all rights of disposition regarding the determination of the conditions of use of Akgünler Ticket Points. In the event of the death of the member, if a death certificate, testamentary document and a notarized waiver indicating that the other heirs have waived their rights are submitted to AKGÜNLER, the Akgünler Ticket Points of the deceased member will be transferred to one of the heirs. transferred Akgünler Ticket Points are valid as of the date they were first earned.

• 3. Akgünler Ticket Point Earning

  Akgünler Ticket Points processed into the Club Card membership account is determined according to the conditions during the period in which the activity that forms the basis for earning Akgünler Ticket Points is carried out. AKGÜNLER has all the rights to dispose of these conditions and the conditions for earning and using Akgünler Ticket Points can be changed unilaterally by AKGÜNLER at any time.

  • 3.1. Earning Akgünler Ticket Points in individual memberships:

    Akgünler Ticket Points are earned from AKGÜNLER (Ferry and Sea Bus) sea travels. The Akgünler Ticket Points which was earned are accumulated in the individual membership account. Akgünler Ticket Points are earned from all tickets purchased for Akgünler travels (including cabins and VIP lounges).

  • 3.2. Situations in which Akgünler Ticket Points cannot be earned:

    Akgünler Ticket Points cannot be earned again from the tickets purchased using by Akgünler Ticket Points in any membership.

  • 3.3. Processing of missing Akgünler Ticket Points:

    Akgünler Ticket Points cannot be earned on the tickets purchased retroactively or on the tickets purchased from the period before the approval date of the membership. Akgünler Ticket Points can only be earned on tickets purchased from the starting the approval date of the membership.

  • 3.4. Akgünler Ticket Points validity period:

    Akgünler Ticket Points are valid for 1 (one) calendar year from the date they are activated. Akgünler Ticket Points that are unused at the end of 1 (one) calendar year were expired and deleted from the membership account.

  • 3.5. Akgünler Ticket Points account statement:

    Members can view their Akgünler Ticket Point account status by logging into their accounts via www.akgunlerdenizcilik.com or www.akgunlerbilet.com. Members are responsible for notifying AKGÜNLER of any changes to their personal informations. AKGÜNLER is not responsible for members not being informed of notifications and announcements due to not updating their personal information and for Akgünler Ticket Points not being earned due to such changes. AKGÜNLER reserves all the rights to announce all types of information regarding Club Card only electronically and not to make announcements in written format.

  • 3.6. Evaluation of objections and correction of records:

    Only AKGÜNLER is the sole authority to evaluate the objections regarding the Akgünler Ticket Point balance account and membership participation of Club Card members. AKGÜNLER reserves all the rights to cancel the Akgünler Ticket Points if it have been recorded incorrectly in the member's account.

• 4. Spending Akgünler Ticket Point

  Club Card are called award tickets. Award ticket purchases with Akgünler Ticket Points can be made via www.akgunlerdenizcilik.com or www.akgunlerbilet.com. Club Card members can purchase an award ticket to another person by using their Akgünler Ticket Points from their own account. Akgünler Ticket Points cannot be earned from the voyages made with award tickets. Akgünler Ticket Points required for award ticket use must be in active status in the Club Card member's account. The opportunities offered may be subject to restrictions determined by AKGÜNLER and AKGÜNLER has all the rights to make additional arrangements and changes regarding the earning and use of certain awards.

• 5. Changes and refunds on award tickets

  The tickets which purchased by using Akgünler Ticket Points can be changed in date but cannot be cancelled or refunded. In case of the cancellation of the trip by AKGÜNLER, Akgünler Ticket Points refunds will be made automatically to Club Card members who purchased tickets using Akgünler Ticket Points. If a round-trip ticket is purchased, cancellation of the outbound trip does not mean the cancellation of the return trip. However, Akgünler Ticket Point refunds can be made for return tickets upon the request of the Club Card member. AKGÜNLER reserves all the rights to make changes to the award ticket applications.

• 6. Other Provisions
  • 6.1. Protection of Personal Data:

    We, as Ak-Günler İşletmeleri Şti. Ltd – Akgünler Denizcilik, inform your esteemed side in accordance with the Law on the Protection of Personal Data (KVKK) that; as the Data Controller, your personal data that you have shared with your express consent in a limited and proportionate manner for the purpose of establishing a transportation relationship will be recorded, stored, preserved and rearranged for the continuation and improvement of the service provided to you, determination of convenient and fast travel points and types for you, structuring of suitable ship voyages, in cases permitted by you, to be able to make commercial communication for sales, marketing and similar purposes and other legal reasons that require the processing of personal data ;We hereby inform you that, in the cases and conditions stipulated by the Law on the Protection of Personal Data (KVKK) , limited to the purpose of data processing and legal reasons in accordance with the legal regulations, these personal data may be transferred, assigned and processed in other ways listed in the Law on the Protection of Personal Data (KVKK) to public legal entities, our affiliated partnerships and/or direct/indirect domestic/overseas subsidiaries, domestic or foreign third parties from whom our Company Ak-Günler İşletmeleri Şti. Ltd. – Akgünler Denizcilik receives services within the scope of the relevant contracts to carry out its activities, cooperates and is jointly and severally responsible with us for taking data security measures such as protecting your personal data, preventing unauthorized access and preventing unlawful processing. Your personal data may be collected verbally, in writing or electronically through channels such as our website, e-mail or call center.

    You can request the following within the framework of Article 11 of the Law on the Protection of Personal Data (KVKK); to learn what your processed personal data is, whether it is used in line with the purpose of processing, the third parties to whom your personal data is transferred domestically or abroad, and to request that your personal data be changed, updated and/or deleted if it is processed incompletely or incorrectly or if there is any change in your processed personal data, and that this situation be notified to the third parties to whom your personal data is transferred. You may exercise your rights within this scope through the following channels in accordance with Article 13/f. I of the Law on the Protection of Personal Data (KVKK):

    • You can apply to the e-mail address [email protected] with an e-mail signed with your secure electronic signature or;
    • You can apply to AKGÜNLER Head Office by courier with a petition bearing your wet signature, or;
    • You can apply by e-mail to [email protected] using your e-mail address registered in our system, which you declared in accordance with the membership/transportation contract.
  • 6.2. Abuse and Violation:

    Those who violate the Club Card General Terms and Conditions, misuse their awards or attempt to gain advantage by providing false information especially regarding travel information, may face legal penalties, compensation payment, termination of their Club Card membership by AKGÜNLER and invalidation of the Akgünler Ticket Points and/or awards they have collected up to that time. AKGÜNLER reserves all the rights to compensate for any damages or loss.

  • 6.3. Termination of Club Card Membership by AKGÜNLER:

    In the event of the following situations, AKGÜNLER reserves all the rights to terminate the Club Card membership without a need of any notice period also AKGUNLER reserves all the rights to provide all kinds of compensation and litigation. In this case, AKGUNLER will not be liable to the member for the Akgünler Ticket Points and other liabilities.

    • Violation of the Club Card General Terms and Conditions by the Member,
    • Violation of AKGÜNLER Transportation Rules by the member,
    • False informations given by the member to AKGÜNLER on any subject,
    • If it is determined that the Member has benefited from the Club Card in a manner contrary to the Club Card General Terms and Conditions and the law,
    • If the member verbally or physically attacks, teases or harass AKGÜNLER employees or other guests, acts contrary to the instructions of the employee on duty, damages the ship or the property of the guests or crew on the ship and similar situations exist.

    Except for the cases stated above, if the Club Card is suspended or withdrawn, the Club Card membership is automatically terminated.

    Club Card Members may terminate their Membership at any time and AKGÜNLER has the right to terminate their membership by notifying the member in advance without giving any reason. Regardless of the reason for the termination of membership, Members cannot claim any rights or receivables from AKGÜNLER.

• 7. Logo

  The ‘SeaMile by Akgünler’ brand logo is as below. Only AKGÜNLER has reserve the rights of using this logo. AKGÜNLER has the right to change the logo at any time.

  

• 8. Applicable Law and Jurisdiction

  The interpretation, implementation and resolution of disputes of this Club Card are subject to TRNC laws. Only TRNC Kyrenia Courts and Enforcement Offices are authorized in the resolution of disputes. However, AKGÜNLER reserves the right to file a lawsuit in other authorized courts specified in the law.
